Webenergy Hosting Terms and Conditions

Hosting Service
Webenergy will provide website hosting 24 hours a day for the duration of the hosting term chosen by the client. Webenergy guarantees 99.9% uptime. Hosting service includes serving html, cfml, asp, aspx, php, MYSQL and SQL Server database depending on the services chosen by the customer.
Any customer using Webenergy's hosting service for pornography, phishing websites, sharing of copywrited material, fraud, or any purpose deemed as illegal in Canada or the United States will have their service terminated immediately without credit or refund.

Domain Service
Webenergy will provide website hosting on the domain name(s) provided by the customer. Webenergy is not responsible for domain names that expire if the domain name(s) is / are registered by the customer.
Domain names that are registered for the customer by Webenergy are billed yearly 30 days prior to the domain name expiry date. If payment for domain registration is not received within 30 days after receipt of the invoice, Webenergy will not renew the customer's domain.
Should the customer's website not be accessible because of an expired domain, there will be no credit given towards hosting.

Email Service
Webenergy will provide POP, IMAP or MS Exchange email hosting and webmail access to enail addresses on its server and ensure 99.9% uptime. Webenergy will provide limited support for setting up and configuring email addresses. Webenergy will add additional email addresses free of charge up to the amount of allowed email addresses in the hosting plan chosen by the customer. Additional email addresses requested by the customer that exceed the amount of allowed email addresses as per the hosting plan are subject to an additional fee and will be billed to the customer.
Any customer using an email addresses hosted on Webenergy's email server for spamming, phishing, advertising pornography, fraud, or any purpose deemed as illegal in Canada or the United States will have their service terminated immediately without credit or refund.

Exchange Email Service
Webenergy will provide Exchange email service and guarantee 99.9% uptime. Limited support is provided for the initial set up and email configuration free of charge. Connection to the Exchange server is provided using SSL 128bit secure encryption. Webmail (Outlook Web Access) is also provided using SSL.
Any customer using an email addresses hosted on Webenergy's email server for spamming, phishing, advertising pornography, fraud, or any purpose deemed as illegal in Canada or the United States will have their service terminated immediately without credit or refund.

FTP Service
Webenergy provides FTP access to transfer files to the customer's website. FTP access is monitored and is subject to termination if there are multiple IP addrresses connecting to the server via FTP using the same account. FTP service is subject to the same terms as hosting with regards to content deemed as illegal in Canada or the United States will have their service terminated immediately without credit or refund.

Support
Webenergy provides free email support with all hosting packages. Telephone support is included only with our Executive and Premium website hosting packages. Telephone support is included with our Exchange Samll Business, Small Business Plus and Business packages. Onsite support and Remote Desktop support are not included with any of our hosting packages and must be purchased separately.

Website Backup
Webenergy backs up customer websites and databases once per week. Should a customer require their website to be restored because of accidently deleting files or improper programming of web pages by the client, then the service of restoring the website is available for an extra fee. Emails can also be restored for an extra fee.

Virtual Hard drive and VPN access
Webenergy provides VPN access to transfer files to the customer's virtual hard drive. VPN access is monitored and is subject to termination if there are multiple IP addrresses connecting to the server via VPN using the same account. VPN service is subject to the same terms as hosting with regards to content deemed as illegal in Canada or the United States will have their service terminated immediately without credit or refund.

Remote Backup Service
Webenergy provides remote backup service and guarantees 99.9% uptime. Backup service is scheduled automatically from the customer's site. Webenergy is not responsible for failed backups due to a failure on the customer's equipment. Webenergy will provide free support for backup failures due to a problem on Webenergy's network or equipment. Remote backup service is subject to the same terms as hosting with regards to content deemed as illegal in Canada or the United States will have their service terminated immediately without credit or refund.

Refund or credit
Webenergy will provide a credit or refund in the event Webenergy was not able to provide the service requested by the customer. A customer has 30 days to request a refund after service has started with Webenergy. The credit or refund will be calculated on a unique basis.
Domain names registered for a customer are not eligible for a refund.

Webenergy's liability
Webenergy is liable for providing the service(s) which the customer has paid for. Events that are out of Webenergy's control such as war, flood, severe weather, and acts of God remove any liability Webenergy has to its customers who have paid for service.
Webenergy is responsible to keep its equipment, internet bandwidth, network, servers and backups in working order and up to the standards of service in which Webenergy offers.
Webenergy is liable for the content on its servers and will at any time monitor the content on its servers. Any illegal content will be removed from the servers and will be reported to law enforcement along with customer's personal information, IP addresses and domain names.
Webenergy cannot be held liable for the inability to provide services under special circumstances sucha as: War, Flood, Military action, fire, earthquake, power outage for extended periods of time, act of God.

Customer content
Content will remain on our servers for the duration of the service paid for by the customer. Should service be terminated at the request of the customer or for non-payment, the customer's content will remain for 30 days after termination of service. Once 30 days have passed after termination of service, the content will be permanently removed from the servers and backups.

Payment
Webenergy accepts payment by credit card or PayPal, Interac money transfer, company cheque or money order. Personal cheques may be given as payment but service will not commence until the cheque has cleared.
Payment for hosting services is due on the date that the service starts. Services that the customer wishes to pay for monthly must be paid for 3 months in advance at the start of the service. Monthly service is billed 30 days in advance after the first 3 months.
NSF cheques will be subject to a $55.00 service fee and immediate termination of service.

Termination of Service
Service will be terminated for non-payment, illegal content or activity, or vioilation of Webenergy's terms. Should service be terminated for non-payment, restoration of service is subject to a restoral fee.
Should service be terminated for non-payment, any content remaining on our servers or domain names will not be given to the customer until payment is received.

Cancellation of Service
Should a customer wish to cancel their service, any content will be accessible to the customer for 30 days after the cancellation provided the customer's account is in good standing. Domain name(s) will be transferred to the customer provided their account is in good standing. A credit will be given to the customer if there is remaining time left in the service agreement after cancellation of the service.
